Intervening Arkansas districts seek school choice stay

Two school districts that intervened in a lawsuit that sought to overturn the state’s school choice law are asking a judge to stay his ruling that the law is unconstitutional.

The Camden-Fairview and El Dorado school districts said Tuesday they did not plan to appeal the decision but want the ruling blocked from going into effect to give the Legislature time to adjust the law.

A group of Malvern parents who wanted to move their children to the Magnet Cove School District sued to challenge the law, which uses race as a qualifier to transfer. The state has used the law to enforce its desegregation efforts.

U.S. District Judge Richard Dawson struck down the law this month, saying that its reliance on race was unconstitutional.
