A mistake by a clerk set an habitual offender free from prison 33 years early and the man is accused of taking part in a home invasion during the time he was supposed to have been locked up, reports the AP. In June, Circuit Judge Robin Green sentenced 22-year-old Cody DeShields to 36 years for residential burglary. But his sentencing sheet says the sentence was 36 months, so state prison officials freed him on parole in October.
The Arkansas Democrat-Gazette reports DeShields was among three men charged with invading a Rogers home on Dec. 1 and robbing and beating the resident.
Prosecutors say DeShields is in custody and his sentence has been amended to reflect the correct length. DeShields is also to be prosecuted on the home invasion charges.
