A former assistant police chief in Alexander who was found to have racially profiled Hispanics is now one of two former officers suing the city for what they say is unpaid overtime, reports the AP. The Arkansas Democrat-Gazette reports that Tommy Leath and Christopher Maher filed the federal lawsuit against the Little Rock suburb and mayor Paul Mitchell.
Mitchell was not mayor when Leath and Maher were officers. He did not return a phone call seeking comment.
The lawsuit doesn’t mention a time period for which the two claim they were not paid overtime wages. Federal law limits such claims to the previous three years.
Leath was forced to resign after a March 2010 ruling that he unconstitutionally racially profiled Hispanic men when he pulled them over for traffic stops in 2007.
