A circuit judge has dismissed a lawsuit against the Arkansas Game and Fish Commission in which a former chairman of the panel claimed the agency was skirting public records law and administrative procedures, reports the Associated Press. Circuit Judge Jay Moody ruled Monday that the commission is bound by the state Freedom of Information Act but is exempt from the Administrative Procedures Act. Former commission chairman Sheffield Nelson, who brought the suit last year, could appeal.
Nelson told the Arkansas Democrat-Gazette he hasn’t decided whether to appeal but says the commission is under closer scrutiny, which is what he wanted.
The commission came under criticism late in 2010 when it tried unsuccessfully to write its own more restrictive version of the state public records law, but it denied accusations in Nelson’s suit.
