A group that filed suit challenging the consolidation of the Weiner School District with the nearby Harrisburg school system has filed a notice saying it will appeal a federal judge’s dismissal of the suit, reports the Associated Press.
The Arkansas Democrat-Gazette reports that Kim Kelley, a lawyer for the Friends of Weiner School District, submitted the notice of appeal Tuesday to the 8th U.S. Circuit Court of Appeals at St. Louis.
On Nov. 29, U.S. District Judge James Moody dismissed the group’s lawsuit, saying Friends of Weiner School District could not prove the harm it claimed would result from the merger of the two districts. The ruling noted that the merger has already occurred, and schools at Weiner are still open.
