The Arkansas Court of Appeals has thrown out a jury verdict in a medical malpractice suit against Hot Springs surgeon Dr. Marc Rogers, reports the Associated Press. It seems Rogers operated on Alan Sargent not long ago, and in the course of the surgery, found a sponge he’d left behind during a gall bladder operation two years prior. The court ruled that leaving a sponge in a patient is not an automatic reason for liability.
